According to a Georgia State Patrol incident report, On September 3rd, 2022, at 2:27 AM, Trooper Clark of LaFayette Post 41 was participating in an approved DUI road check at West 3rd Street and North 2nd Avenue in the city of Rome, GA. A gray 2019 Honda HR-V b being driven by Courtney Alicia Linley, 31, of Atlanta, drove through the checkpoint. Trooper Clark reported, “While [I] was speaking with Mrs. Linley, [I] observed her eyes to be bloodshot and watery. Also, [I] could smell a strong odor of alcoholic beverage coming from Mrs. Linley’s person. [I] asked Mrs. Linley how much alcohol she had drank tonight, and she stated, “enough to have a good time.” During field sobriety tests, Linley showed several signs of impairment. Linley was placed under arrest for DUI. Trooper Clark reported, “While [I] was reading the implied consent card, Mrs. Linley was talking over me. When asked if she would submit to the state-administered chemical test of your blood, Mrs. Linley stated that [I] did not read her rights to her correctly and that she did not know if there was a period or comma in what [I] read to her, which her response was taken as a refusal to the blood draw. While en route to the detention center, Mrs. Linley stated, “I would hate to hit my head like this”. Mrs. Linley then slammed her head into the back glass of the partition. Mrs. Linley was advised to stop hitting her head.” Linley was booked into the Floyd County Jail and charged with DUI.
