According to a Floyd County Police Department incident report, on January 14th, 2022, at approximately 8:15 PM, Officer Forrister arrived on the scene of a vehicle crash that had occurred on Lyons Bridge Road near its intersection with Mary Mac Road. Officer Forrister reported, “While en route to this location, other officers had arrived on the scene before me, and [I] was advised by Cave Spring Officer M. Baxter that the driver of the vehicle had admitted to drinking alcohol. Officer Masciovecchio had also come on the scene before my arrival. [I] was able to see that a black Hyundai vehicle had left the roadway and impacted trees on the roadside with the front of the vehicle. [I] did speak with the driver Donald Higgins, 59, of Byron, Peach County, GA, and when [I] asked him if he had been drinking, he advised that he had. [I] asked Donald if he felt he was safe to drive, and he advised he was. At this point, [I] was able to smell the odor of an alcoholic beverage coming from Higgins.” When Higgins stopped leaning on the Cave Spring Patrol vehicle, it became apparent that he was having problems balancing at this time. During field sobriety tests, Higgins showed several signs of impairment and then showed a positive result for BAC on a PBT. Officer Forrister reported, “Higgins was again asked about drinking, and he advised he had 2-3 beers.” Higgins was read implied consent for blood, and he did agree. Higgins was transported to the Floyd County Jail charged with DUI.
