Calhoun man arrested for DUI after refusing to exit vehicle and resisting arrest during traffic stop 

According to a Gordon County Sheriff’s Office incident report, On October 26th, 2022, at 11:02 PM, Sgt. Powell was patrolling Redbud Road near Devonwood Drive. According to the report, “Sgt. Powell observed a White Chevrolet Suburban sitting in the parking lot of the dentist’s office. The vehicle was diagonally facing the intersection of Redbud Road and Devonwood Drive. It appeared to Sgt. Powell that the vehicle was about to drive down the steep embankment onto Redbud Road. Upon sight of Sgt. Powell’s marked patrol vehicle, the Suburban, backed up and drove to the corner of the parking lot opposite from the exit and tried to maneuver as if it were going to try to drive around behind the dentist’s office. As the vehicle exited the parking lot Sgt. Powell placed his patrol vehicle behind the vehicle and activated his blue lights to initiate a traffic stop. The vehicle came to an abrupt stop, half on the driveway and half in the yard of 106 Windsor Drive.” Sgt. Powell then made contact with the driver, later identified as Terry James Green, 57, of Calhoun. Sgt. Powell asked him what he was doing in the parking lot of a business that had been closed for approximately six hours. Green stated that he had pulled over to use the phone and that he had not broken any laws. Sgt. Powell immediately noticed that he had watery eyes and slow, slurred speech, as well as the strong odor of an alcoholic beverage coming from Green’s breath. When asked for his license, Green continued to state that he had not broken any laws and that Sgt. Powell had no reason to be stopping him. According to the report, “Sgt. Powell explained the reason for the stop several more times. Sgt. Powell opened the door of the vehicle and asked Mr. Green to step out. Mr. Green stated that he knew his rights and continued to ignore Sgt. Powell’s lawful commands.” Sgt. Powell advised Green several times that if he did not exit the vehicle, he would be physically removed from the vehicle and charged with obstruction. Green refused all commands and still failed to comply with the lawful orders. Green attempted to hold on to the steering wheel and prevent being removed from the vehicle. Green refused to comply after being removed from the vehicle and resisted arrest. After a brief struggle Sgt. Powell was able to get Green into custody for obstruction and DUI driving under the influence. Green then refused the state implied consent test.
