According to a Gordon County Sheriff’s Office incident report, on January 4th, 2022, at approximately 7:19 PM, Deputy Mills was on patrol in the area of Sugar valley Road and Pocket Road. According to the report, “Deputy Mills observed a White Chevrolet Trailblazer fail to stop at the stop sign on Pocket Road coming onto Sugar valley Road. Deputy Mills observed the White Trailblazer fail to maintain its lane traveling North on Sugar valley Road just past Main Street. Deputy Mills conducted a traffic stop with the White Chevrolet Trailblazer.” The deputy then made contact with the driver Thomas Whittier Gates, 65, of Calhoun, and advised the reason for the traffic stop. According to the report, “Mr. Gates stated yeah it was one of those California stops like a rolling stop. Mr. Gates stated he failed to maintain due to being nervous when Deputy Mills was behind him. Deputy Mills could smell the odor of an alcoholic beverage coming from the vehicle. Deputy Mills observed Mr. Gates’s eyes to be glossy and bloodshot. Deputy Mills could smell the odor of an alcoholic beverage coming from Mr. Gates person.” During field sobriety tests, Gates showed several signs of impairment and almost fell over. According to the report, While searching the vehicle, the deputy located two used syringes inside the door panel of the driver’s side door. The deputy also located a red solo cup cold to the touch with ice and an alcoholic beverage inside the center console. According to the report, “Deputy Mills observed a Yeager liquor bottle in the passenger seat that had been opened. Deputy Mills located a black bag with several small bottles of Fireball liquor hanging off the gear shifter. Deputy Mills located a fireball liquor bucket in the back seat with several small fireball liquor bottles inside of it. Deputy Mills observed a soft cooler with different types of alcohol bottles inside of it.” Gates was read Georgia implied consent notice and stated no refusing the state test. Gates was transported to the Gordon County Jail charged with DUI, failure to stop for stop sign, failure to maintain lane and open container.
