Calhoun man charged with DUI after domestic dispute in Gordon County

According to Gordon County Sheriff’s Office incident report, on April 4th, 2021, at approximately 10:18 PM, Deputy Mills responded to an address Old Rome Dalton Road in reference to a domestic dispute. The deputy observed a black in color 1995 Honda Accord with the door open and the keys in the ignition. The deputy also observed a bottle of Smirnoff Vodka with a small amount left in the bottle. Russell Heath Ferguson, 51, of Calhoun, was lying on the ground. When asked if he needed medical attention, Ferguson stated no he liked laying on the ground. The deputy could smell a strong odor of alcohol coming from Ferguson’s person. Ferguson was asked if he had been drinking and stated, “to be honest, I have a bad liver, but I drank a little bit.” The complainant stated Ferguson showed up to his residence drunk, and he did not want him there. The complainant stated that he did not want him trespassed due to him being his brother-in-law. Deputy Payne spoke with Ferguson about how he had gotten to the residence. Ferguson advised he was at the Cemetery on Harmony Road and he was just going to sleep in his car. Deputies advised Ferguson that he was at his sister’s residence. Ferguson struggled to stand and was off balance. Ferguson stated that he would not blow into the portable breath test. Ferguson refused all further tests and was placed under arrest for DUI. Ferguson was transported to the Gordon County Jail charged with DUI.
