Calhoun man found DUI after driving recklessly through Dalton bar parking lot

According to a Dalton Police Department incident report, on January 21st, 2021, at around 2:45 AM, while Officer Mefford was patrolling the area of the Oyster Pub located at 933 Market Street. The officer viewed a vehicle leaving the parking lot at an extremely high rate of speed. Before the officer could catch up to the vehicle, it turned into the Race Trac parking lot at 1511 West Walnut Avenue. The vehicle pulled into several locations before it turned east on West Walnut Avenue. The vehicle then made a u-turn heading back west. The officer initiated a traffic stop, stopping the vehicle on the I-75 southbound on the ramp. Officer Mefford reported, “When [I] made contact with the driver, Freddy Cruz, 25, of Calhoun, [I] could detect an odor of an alcoholic beverage coming from inside the vehicle. [I] also noticed that Freddy’s eyes were glassy.” The officer advised Fredy he was stopped because he was driving recklessly when he left the Oyster Pub. The officer also explained that it was very suspicious that he would turn into parking lots every time a patrol vehicle got behind him. Freddy advised that he had not had anything to drink when asked. When asked to get out of the vehicle, Freddy stated that he did not think it was necessary for him to have to get out of his vehicle. Officer Bethune arrived to assist and asked Freddy how much he had drunk. Freddy then changed his answer, stating that he had drunk two beers at the bar. Freddy showed several clues of impairment and gave a positive breath alcohol content on the Alco-Sensor. Freddy was placed under arrest for DUI. Oscar Monterroza, 20, a passenger in the vehicle, lied about his information to officers and stated it was because he was not a US citizen. He also stated it was because he had been drinking and was underage. Since he lied about his name and date of birth, he was placed under arrest as well. At the Whitfield County Jail, Freddy showed a blood alcohol count (BA) of .073 grams of alcohol. Monterroza showed a breath alcohol content of .040. Freddy was charged with reckless driving and DUI less safe Monterroza charged with providing a false name and date of birth and underage consumption.
