According to a Georgia State Patrol incident report, on Friday, July 2nd, 2021, at approximately 3:21 PM, Trooper Haney observed a black Chevrolet Cavalier traveling east on GA 136 near Fite Bend Road, fail to maintain its lane to the right multiple times, traveling over the fog line. Trooper Haney performed a traffic stop on the vehicle and made contact with the driver identified as Nicholas Lynn Couch, 38, of Canton. Trooper Haney reported, “While talking to Mr. Couch, [I] could smell a strong odor of an alcoholic beverage coming from his breath. [I] also noticed his speech was slurred. [I] also noticed his eyes were bloodshot and watery. [I] asked Mr. Couch why he couldn’t keep his vehicle in his lane, and he stated that he was reading a text message.” When asked how much he had to drink Couch, he stated “a couple at lunch”. Couch agreed to perform Standardized Field Sobriety. During Horizontal Gaze Nystagmus Couch showed six out of six clues of impairment. Couch showed a .220 ABC on portable Alco-Sensor. Couch was then placed under arrest for DUI. Couch verbally agreed to the state test for his breath. Couch was transported to the Gordon County Jail, where he showed a .216 BAC on the state test. Couch was charged with DUI child endangerment, distracted driving/use of cell phone, DUI driving under the influence of alcohol, and failure to maintain lane.
