According to a Whitfield County Sheriff’s Office incident report, on May 2nd, 2021, at around 2:26 AM, Deputy Figg was dispatched to the McDonalds located at 2531 East Walnut Avenue in reference to a driver in the drive-through of the McDonalds passed out and not responding. The deputy arrived and made contact with the red Ford Focus. According to the report, “Deputy Figg knocked loudly on the driver window without being able to wake the driver. Deputy Figg pounded on the window several times, finally causing the driver, Nicholas Garcia, 21, of Chatsworth, to arouse. After several more times of pounding on the driver’s window, Nicholas awoke. Nicholas looked at Deputy Figg and reached over, turning up his car stereo. Deputy Figg knocked loudly, advising Nicholas to roll down his window.” After several more times of knocking on the window, Nicholas rolled down the window. While speaking with Nicholas, the deputy noticed the odor of some type of alcoholic beverage coming from him. Nicholas was asked if he had anything to drink and stated 1 to 2 beers. Nicholas showed several clues of being impaired. The deputy placed Nicholas under arrest for DUI. Nicholas agreed to Georgia’s Implied consent for his breath. Nicholas was transported to the Whitfield County Jail, where he blew a .129 on the state test. Nicholas was charged with DUI-driving under the influence of alcohol.
