According to a Dalton Police Department incident report, on February 23rd, 2021, at around 11:00 AM, Officer Bell responded to West Walnut Avenue and Dug Gap Road in reference to a single-vehicle crash that the WCSO deputy was out with. When the officer arrived, he noticed a 1996 Chevy Chevrolet had run off of the roadway and into the bushes at the Kroger located at 1365 West Walnut Ave. The officer made contact with the Whitfield County deputy, who stated that he noticed the vehicle in the bushes. The deputy turned around and got out with the vehicle to check welfare. The deputy advised that the driver, later identified as John Rob Deaver, 39, of Cleveland, TN, was walking through the parking lot and that the passenger was left with the vehicle. The passenger stated that Rob was picking her up. She stated that she went to high school with Rob and that they reconnected over Facebook. She stated that Rob was picking her up from Kroger and taking her back to Cleveland. She stated that Rob had recently been in rehab for alcohol. Rob was brought back to the scene by the deputy. When asked to do field sobriety so they could confirm that he was ok to drive. Rob stated no because he wasn’t driving. Rob stated that he felt that it already looked bad and that he felt that it would incriminate him. Rob then admitted to driving the vehicle. Officer Bell smelled the odor of an alcoholic beverage coming from his person and noticed that his eyes were extremely red and glassy. Rob showed several clues of impairment and tested positive for alcohol with a breath alcohol content of .152. Rob was placed under arrest for DUI-driving under the influence of alcohol. Rob refused any state test. Rob was charged with DUI – alcohol less safe, failure to maintain lane on, and fleeing the scene of crash.
