According to a Dalton Police Department incident report, On June 10th, 2022, at 2:38 AM, Officer Guerrero conducted a traffic stop on a black passenger car due to this vehicle having a passenger in it that was involved in a domestic that had just occurred. Officer Guerrero reported, “Before [I] conducted the traffic stop on the vehicle, it was stopped in the parking lot of Park Canyon Apts. [I] then turned my blue lights on and conducted a stop on the vehicle. At this time, the vehicle remained stopped at the entrance/ exit to the apartments. The vehicle had its left-hand blinker on. The vehicle remained stopped for a couple of seconds, then began rolling forward. The vehicle then turned right onto College Drive and continued to drive southbound. At this time, [I] continued to follow the vehicle with my blue lights on. The vehicle was traveling at approx 15 mph on College Dr. The vehicle then turned right onto Mount Heaven Drive and then finally parked at the Brown Hall Dalton State building.” While the officer was talking to the occupants of the vehicle, he could smell a very strong odor of alcohol coming from within the vehicle. Officer C. Jenkins talked with the driver, identified as Tanner Anthony Thomas, 23, of Cohutta, and detected a very strong odor of alcohol coming from Thomas’s breath. Tanner’s speech was slurred, and his eyes were red. Officer Morang informed other officers that the subjects from domestic had just told him that Tanner was very intoxicated and drunk. According to the report, “They knew this due to them all being together prior to the disturbance.” Tanner advised officers he had his last beer at 11:00 PM at the braves game. During field sobriety tests, Tanner showed several signs of impairment. Tanner was then placed under arrest for DUI and agreed to the state test. Tanner was transported to the Whitfield County Jail. Officer Guerrero reported, “On the way to the jail, Tanner informed me his alcohol level was going to be low and that he was currently like this because he had taken delta 8 gummies. [I] asked Tanner what delta 8 gummies were, and he informed me he had a couple of CBD gummies, and that’s why his eyes were red. [I] was further told he bought them at an “Indian” store. Tanner showed a BAC of .101 on the state test and was booked for DUI .08 grams or more.
