According to a Dalton Police Department incident report, on September 18th, 2021, at around 3:13 AM, Officer Black responded to a vehicle crash at West Walnut Avenue and South Tibbs Road. According to the report, the crash was dispatched over the radio as a vehicle in the ditch with unknown injuries. Officer Black reported, “[I] made contact with Officer Johnson and Officer Lewis who had already made contact with the driver identified as Zachary Lee Hardin, 28, of Dalton. The vehicle was in a large ditch in front of the Steak and Shake. Officer Johnson advised dispatch that the driver was unconscious at that time. Once [I] got to the vehicle, Zachary had woken up but was in an altered state. While standing next to the vehicle, [I] was able to smell an odor of alcohol coming from the vehicle.” When EMS arrived Zachary advised he did not want to go to the hospital. The officer asked Zachary if he would do some field sobriety test to insure he is okay to drive. Zachary responded with “I’m not okay to drive”.
According to the report, During field sobriety tests, Zachary displayed a lack of coordination, difficulty standing, and exceptionally poor, slurred, mumbled speech. Zachary was then placed under arrest for DUI driving under the influence. Officer Black reported, “[I] read Zachary implied consent for subjects over 21 from my department issued implied consent card. Zachary stated he did not wish to provide a breath sample for the state administered test.” Zackary was transported to the Whitfield County Jail charged with DUI less safe alcohol and failure to maintain lane.
