According to a Dalton Police Department incident report, On May 30th, 2022, at 1:07 AM, Officer D. Jones was sitting in the parking lot of the Circle Church located at 1002 North Glenwood Ave, observing traffic. The officer observed an F-150 following way too close to another vehicle and then observed it make an erratic lane change while traveling 49 mph in a 35 mph zone. The F-150 then cut sharply back over in front of the original truck it was following close behind. The officerinitiated a traffic stop in the Mcdonald’s parking lot. Officer Jones then made contact with the driver, later identified as Bailey Ryan Jones, 18, of Dalton. Officer Jones reported, “[I] immediately detected the odor of what [I] believed to be marijuana coming from inside the truck. [I] questioned Bailey about the odor of marijuana coming from within the vehicle, and he said that the middle passenger, identified as Leslie Leyva, had smoked earlier but that he had not smoked marijuana with her. At this point, [I] requested another unit to come to assist me due to knowing [I] would be searching the truck. [I] had the two rear passengers (identified as Leslie Leyva and Sheyna Cesspooch) write down their information on my notepad. Officer Selby arrived on the scene and assisted with the traffic stop. Officer Selby made contact with Bailey, who admitted to lying and that there was marijuana inside the truck. Bailey also advised he had smoked prior to driving. During field sobriety testing, Bailey showed several signs of marijuana impairment and was placed under arrest for DUI. Cesspooch returned with a BAC of .062 sample, and Leyva returned with a BAC of .075 sample. Officers also located two open containers in the passenger’s seat back cargo pouch, one being a twisted tea can, and the second was a Strawberita. Based on Cesspooch and Leyva’s (both teenagers) samples returning higher than .00, [I] issued both females citations for underage consumption and open containers. Bailey was charged with speeding, open container, and DUI – marijuana.
