According to a Dalton Police Department incident report, On June 25th, 2022, at 2:18 AM, Officer Selby stopped a 2016 Nissan Sentra failing to maintain a single lane driving all over East Morris Street. The officer then made contact with the driver, Juan Carlos Ramirez, 24, of Dalton, who stated that he was sorry. Officer Selby reported, “[I] noticed that Juan’s eyes were extremely red and bloodshot. [I] also observed Juan have a paper bracelet which is common for bars and clubs to put on their customers to signal who is 21 years or older and can have alcohol. [I] then asked Juan how much he had to drink, and he said, “A little”.” During standardized field sobriety tests, Juan showed several signs of impairment. Officer Selby reported, “During this test, Juan would not provide a proper breath sample. During this time, [I] started to detect a strong odor of alcohol coming from Juan’s breath.” Juan was placed under arrest for DUI and kept asking what he failed when being read implied consent, so the officer took it as a refusal on the state test. Juan was transported to the Whitfield County Jail, where he was charged with DUI and failing to maintain a single lane. Officer Selby reported, “Once at the jail, [I] filled out an ALS form due to Juan refusing to provide a breath sample on the Intox 9000. [I] explained this form to Juan, and he signed. [I] then took his license, which will be sent off to Georgia DDS”.
