According to a Dalton Police Department incident report, On April 3rd, 2022, at 3:05 AM, Officer Selby was traveling south on North Glenwood Avenue around the area of Mitchell Street when he observed a red Toyota Camry slowing turning onto Mitchell Street in a manner that was unusually slow. The officer then stopped the vehicle after observing the vehicle driving completely in the opposite lane of travel. When Officer Selby made contact with the driver, Juan Zablah, 53, of Dalton, he reported he could detect a strong odor of an alcoholic beverage coming from inside the vehicle. Officer Selby reported, “[I] also noticed that Juan’s eyes were extremely red. [I] explained to Juan why he had been stopped. [I] then asked Juan how much he had been drinking. Juan answered that he had “Only one”. [I] then asked what he drank, and he said he had one beer. When Juan reached the rear of his vehicle, [I] again detected a strong odor of an alcoholic beverage coming from his person/mouth area. [I] also observed that his eyes were very red.” During a standardized field sobriety test, Juan began to cry and say he was stressed. He then later stated that he is drinking because of his stress. According to the report, “During the battery of tests, Juan displayed a lack of coordination, difficulty standing, and exceptionally poor, slurred, mumbled speech.” Juan was placed under arrest for DUI driving under the influence of alcohol and refused the state test. Juan was transported to the Whitfield County Jail, charged with DUI and weaving over the roadway.
