According to a Dalton Police Department incident report, On October 7th, 2022, at 11:53 PM, Officer McBrayer responded to the area of Walnut Avenue and Dug Gap Road in reference to assisting Officer Gilreath with a traffic crash. She advised Officer McBrayer that the male driver, Bailey Ryan Jones, 19, of Dalton, of the silver Maxima, was making some strange mannerisms and was not accurately answering her questions. She advised that she suspected that he may be under the influence. Officer McBrayer reported, “Jones was at the rear of his car smoking his electronic cigarette a lot. His rate of usage appeared to be more than that of the average consumer. [I] then made contact with Jones. When [I] walked up to him his eyes were barely open and when [I] began asking him questions, [I] could tell that he was slurring his speech. [I] also noticed that he had two different sized pupils while looking at his eyes. [I] immediately called for EMS because this is usually a sign of head trauma.” Jones advised it was from brain surgery he had when he was a child. During field sobriety testing, Jones showed several signs of drug impairment. Jones was placed under arrest for DUI and agreed to the state test. Jones was booked into the Whitfield County Jail, charged with DUI less safe and following too closely.
