According to a Whitfield County Sheriff’s Office incident report, On September 25th, 2022, at 1:04 AM, Deputy Figg responded to a crash on Renfro Road just before the cut-off. According to the report, “Deputy Figg arrived on scene about the time dispatch advised the possible driver was at an address about three-quarters of a mile from the accident location. Deputy Figg stayed with the vehicle to make sure there were no more people in the vehicle, which there were not. Deputy Figg then went to where Deputy Dennison had located the subject, later identified as Carlos Eduardo Rivera, 26, of Dalton, in the roadway. Deputy Figg reported Fire and EMS was arriving on the scene. The deputy also observed Carlos talking and not listening as Deputy Dennison and EMS were trying to find out what had happened. Carlos stated he had been drinking but only had one beer and a shot. Carlos was not able to advise what happened and kept changing his story stating as he was driving, someone pulled a gun on him. As EMS was trying to get Carlos to go to the hospital due to his injuries and cuts to his head, Carlos continued to be verbally confrontational with EMS. Due to his extremely intoxicated state, Deputy Figg took warrants for Carlos for too fast for conditions, single lane violation, DUI, Pedestrian under the influence, and for leaving the scene of an accident. On October 7th, 2022, Carlos was arrested and booked into the Whitfield County Jail.
