According to a Dalton Police Department incident report, On May 21st, 2022, at 6:24 PM, Officer Marcus was dispatched to a single-vehicle crash at Underwood Street and Jamestown Ct. According to the report, “Dispatch advised that the vehicle was in a ditch and the driver was attempting to get the vehicle out. The caller advised dispatch that the driver was staggering and appeared to be extremely drunk.” The officer arrived and observed a blue passenger car with multiple airbag deployments in a ditch. The officer also observed the driver, Justin Anselmo Lopez, 24, of Dalton, attempting to drive the vehicle out of the ditch. Officer Marcus reported, “Justin had a difficult time maintaining his balance. He also had slurred speech. [I] could detect the strong odor of alcohol coming from Justin. When [I] asked Justin what happened to the car, he began to tell me about how “Badass” his car was.” Justin refused to take any field sobriety tests and refused the state test. The officer also observed two small bottles of alcohol that had been opened and were halfway consumed in the driver’s area of the vehicle. Justin was transported to the Whitfield County Jail, charged with DUI less safe, failure to maintain lane, and open container violation.
