Dalton man arrested for DUI after driving off in vehicle involved in pedestrian crash in Whitfield County

According to a Whitfield County Sheriff’s Office incident report, On May 21st, 2022, 6:30 PM, Deputy Sullivan, and Deputy Fernandez were assisting Georgia State Patrol with a Vehicle Vs. Pedestrian crash in the area of Boyles Mill and River Road. According to the report, “During the investigation, Deputy Fernandez observed the involved vehicle leaving the scene of the crash. A firefighter advised Deputy Fernandez that the involved party’s father (later identified as Michael Bivens, 57, of Dalton) got in the vehicle. The firefighter also advised that he was told that the subject had been drinking. Deputy Fernandez then went to his patrol car and took off after the subject. Deputy Fernandez caught back up with the black Acura approximately one-half mile away, and the vehicle pulled over when he saw Deputy Fernandez`s vehicle coming upon him. Deputy Fernandez asked him why he left, and he stated that “he told me I could take it to the house” Deputy Fernandez asked him who told him that then he began nodding and apologizing. At this time, Trooper Boyd arrived on the scene and began Telling Mr. Bivens that nobody told him he could leave because he was conducting a crash investigation. Deputy Fernandez asked Mr. Bivens if he had been drinking, and he stated that he had. When asked how many, he stated that he only had two beers.” During field sobriety tests, Bivens showed several signs of impairment and showed a BAC of .137 on a PBT. Bivens was placed under arrest for DUI. According to the report, “Mr. Bivens was then read implied consent for suspects over the age of 21. Mr. Bivens agreed and stated, “aint no reason to try and d**n deny it.” Bivens was then transported to the Whitfield County Jail, where he showed a BAC of a .131. He was charged with DUI and driving on a suspended license. According to the report, “While at the jail Mr. Bivens was sitting and chuckling and made the statement “I know I screwed up, but you can’t help but laugh it off, I was just trying to save him from a tow bill.”
