According to a Dalton Police Department incident report, On October 2nd, 2022, at 2:39 AM, Officer O’Neal was parked in the southeast corner of North Glenwood on Mccune Street watching traffic when he observed a red 1999 Dodge Durango southbound in the northbound traffic. The officer observed the vehicle was all over the roadway and was bumping the curb several times. Officer O’Neal initiated a traffic stop and made contact with the driver, identified as Esmalin Rene Chavez, 28, of Dalton. Officer O’Neal reported, “After explaining why [I] pulled him over, [I] asked if there was any reason for driving on the wrong side of the road. Chavez answered, “My bad, [I] was just in a hurry,” [I] asked him where he came from he stated downtown he was trying to get money out of the bank. [I] asked if he had anything to drink, and he told me no. [I] asked if he had used any drugs. He told me he had just smoked weed before driving. When he gave me his driver’s license, he grabbed a few other things, looked at them intensely between each, then gave me it.” Officer Cook arrived on the scene and assisted. Chavez then admitted to having some alcoholic beverages before driving. Officer O’Neal reported, “At this time, while talking to him, [I] could smell the strong odor of alcoholic beverage and observed his eyes to be red and glossy.”During standardized field sobriety test, Chavez showed several signs of impairment and a BAC of .127 on a PBT. Chavez was placed under arrest for DUI and agreed to the state test. Chavez was transported to the Whitfield County jail, where she showed a BAC of .133 on the state test. Chavez was charged with DUI with .08 grams or more and driving on the wrong side of the road. Chavez was also issued a warning that the tag on the vehicle expired on the 22nd of last month.
