Dalton man arrested for DUI after leaving party and causing two-vehicle crash while distracted by phone

According to a Dalton Police Department incident report, On October 30th, 2022, at 5:00 AM, Officer Lewis arrived in the area of Abutment Road and Bear Creek Road in reference to a vehicle crash with injuries. During the investigation into the crash, Officer Lewis spoke with the at-fault driver, identified as Josue Cruz. Officer Lewis reported, “As [I] spoke to Cruz, [I] asked what had happened. He stated that he was going south on Abutment Road and was trying to turn left onto Bear Creek Road. He stated that he was distracted by his phone and was not paying attention to the road. He stated that due to his being distracted, he turned left in front of the other vehicle and caused the wreck. [I] observed that Cruz had on a “Glow stick” necklace that is commonly worn at parties. [I] asked him about this, and he stated that he was at a Halloween party a while ago. He stated that while he was at the party, he only had about three beers. While speaking to Cruz, [I] did detect the strong odor of alcohol on his breath. His vehicle also smelled of alcohol, with some odor of marijuana as well. When asked about the marijuana, he stated that he did smoke as well”. During field sobriety testing, Cruz showed several signs of impairment and refused to blow into a PBT. Cruz was then placed under arrest for DUI less safe, and he refused the state test. An administrative license suspension form was completed, and Cruz did sign it. Cruz was booked into the Whitfield County Jail, charged with distracted driving, failure to yield while turning left, DUI alcohol less safe.
