Dalton man arrested for DUI after nearly causing crash in front of DPD officer on Walnut Avenue

According to a Dalton Police Department incident report, on November 20th, 2021, at 2:37 PM, Officer Parson was patrolling East Walnut Avenue near Sheridan Avenue. Officer Parson reported, “During my patrol [I] noticed a vehicle, facing westbound on Walnut Avenue in the left turning lane to go south on Sheridan Avenue. As [I] was driving eastbound on Walnut Ave, [I] noticed the vehicle make his left-hand turn while myself and other vehicles had the green light to continue straight. A vehicle in front of me had to slam on its brakes to avoid a collision with the vehicle.” Officer Parson got behind the vehicle and conducted a traffic stop. The vehicle continued on Sheridan Avenue all the way to the intersection at Nolan Drive. Officer Parson reported, “As [I] got near the driver’s side door, [I] noticed the driver, later identified as Zachary Curtis Fox, 34, of Dalton, look at me nervously and open the door to try and get out.” The officer got closer to his door and pushed it shut, telling him to stay in the vehicle. According to the report, Fox seemed to not understand why he was stopped could not say a complete sentence, mumbling under his breath. Fox could barely talk and would stare blankly. The officer ran Fox through GCIC, which returned showing that he had an active warrant for his arrest through Whitfield County and that his license was suspended. Officer Parson reported, “When he got out of his vehicle, [I] smelled a strong odor of alcohol coming from his person. [I] then asked Fox how much he had to drink. He advised, “Two” beers.” Officers walked around his vehicle and noticed an open container in the passenger floorboard in plain view. Fox then stated “No” he did not wish to participate in field sobriety testing or questioning after being advised of his rights. He also did not wish to participate in the state testing of his breath. Fox was transported to the Whitfield County Jail charged with safety belt violation, driving while suspended, open container, DUI alcohol less safe, failure to yield while turning left and the warrant was served.
