According to a Dalton Police Department incident report, on November 6th, 2021, at around 12:45 PM, Officer Avila responded to East Walnut Avenue at Airport Road in reference to a vehicle crash with injuries. According to the report, Whitfield County deputy Thompson who was on the scene advised the officer. Deputy Thompson walked the officer over to a utility pole not far off from the vehicle crash. The deputy informed the officer that he observed the male, later identified as Michael Steven Voyles, 55, of Dalton, who was driving the red passenger car exit and moving quickly to the utility pole. The deputy observed Michael emptying something behind the utility pole. Michael then dropped something and ran back. Officer Avila reported, “[I] observed an empty plastic alcoholic beverage/container behind the utility pole. The officer asked Michael, “Is that your alcoholic beverage bottle?” Michael would not answer but told the officer that he wanted medical attention. Officer Avila reported, “[I] asked Michael, “Why did you go behind the utility pole to pour out an alcoholic beverage?” Michael had slurred speech when he would respond and [I] had to ask him multiple times to get a response. Michael got upset and stated that he did not do that. Officer Bethune asked Michael, “Do you have an alcoholic beverage with you?” Michael stated that he did have one in the car but would not specify. Michael was not coherent, had slurred speech, was drowsy, and would get angry when [I] asked him any questions regarding the crash.” Michael advised he was too injured from the crash to perform a field sobriety test. Officer Bethune then read Michael implied consent, and Michael agreed to get his blood drawn. Michael continued to show signs of being under the influence of alcohol, not being able to speak clearly, having glossy eyes, and not being aware of his surroundings. Officers spoke with the crash victim at Hamilton Medical Center. She stated that she was stopped at the stop sign near the intersection of East Walnut Avenue at Airport Road. She stated while stopped, Michael crashed into her vehicle. She stated she is approximately nine months pregnant. Michael was booked into the Whitfield County Jail, charged with DUI, less safe alcohol, failure to maintain lane, suspended license, and too fast for conditions. According to arrest records, Michael has a history of DUI arrest, and his license is suspended for DUI.
