According to a Whitfield County Sheriff’s Office incident report, On March 20th, 2022, around 5:00 AM, Deputy Caraway was traveling South on Georgia 3 around Mansfield Dr. According to the report, “Deputy Caraway noticed a white in color Audi Sports Utility Vehicle in the right-hand lane. Deputy Caraway noticed the vehicle due to the vehicle failing to maintain its lane. Deputy Caraway observed the vehicle going side to side in its lane and also crossing the fog line with both passenger-side tires. Deputy Caraway conducted a traffic stop on the vehicle on South Dixie Hwy just off of GA 3.” The deputy then made contact with the driver Oscar Alanis, 20, of Dalton, and could smell an odor of marijuana coming from the vehicle. According to the report, “Deputy Caraway asked Mr. Alanis when was the last time he had smoked marijuana. Mr. Alanis stated that he was not going to lie and stated that he was just smoking it.” During the Horizontal Gaza Nystagmus test, the deputy observed six out of six clues of impairment. Alanis had a lack of smooth pursuit, distinct and sustained Nystagmus at maximum deviation, and onset Nystagmus prior to 45 degrees. All clues were observed in both eyes. During the test, Mr. Alanis was also swaying front to back. Alanis showed several signs of impairment during the other field sobriety tests and was placed under arrest for DUI, and refused the state test. While searching Alanis, the deputy found a baggie with cocaine inside. Alanis was transported to the Whitfield County Jail, charged with DUI-drugs, possession of cocaine, and failure to maintain lane.
