According to a Floyd County Police Department incident report, on June 27th, 2021, at around 12:29 AM, Officer Newport and Officer Dollar responded to East 2nd Street in reference to a fight involving a gun. According to the report, Dispatch advised the neighbor from across the street came over and began making threats. Upon our arrival, officers were met by Tony Ray Tortoso, 30, of Lindale, in the driveway of the dispatched address. Officer Newport reported, “[I] noticed Tony was having some difficulty keeping his balance and could smell the odor of an alcoholic beverage coming from his person. Tony stated that he was “drunk” and was out in town in Rome drinking. Tony stated that he left Broad Street and took an Uber back to his residence. Tony stated that once he returned home, he noticed a party was going on at his neighbor’s house. Tony stated that he walked over into his neighbor’s yard to go party with them.” Officer Dollar reported, “Tony was very intoxicated based on his slurred speech and stumbling around. All parties advised that the neighbor from across the street came over and shouted, “I will wax you all!” This was a threat to do bodily harm to the subjects. After Tony made the threat, the victim pointed his pistol at Tony and stated to Tony that he needed to leave. Tony allegedly continued shouting things at the subjects until police arrived. [I] advised Officer Newport to place Tony into custody.” Tony was transported to Floyd County Jail, charged with Terroristic Threats and Acts, and Public Drunkenness.
