According to a Dalton Police Department incident report, on April 17th, 2021, at around 2:08 AM, Officer Avila responded to an address on James Street in reference to a disturbance in progress. Dispatch informed Dalton PD units responding that a male was in the middle of the road arguing with a female. Units were also advised that the male was drunk as well. Officer Avila was close by and arrived very quickly. Officer Avila reported, “[I] observed a male and female facing each other arguing with one another. The officer spoke with a witness who stated male, later identified as Fernando Mancillas Cordero, 26, of Marietta, GA, was the female’s ex-boyfriend, and he would not let the female leave. The officer separated both Fernando and his ex to further investigate. Officer Avila reported, “[I] said, “Hey, what is going on?” towards the individuals arguing. At that time, the male (Fernando) moved the female in front of him and began to sprint towards me. The male then drew his right fist back and swung his right fist towards my face in an attempt to cause harm to me. [I] dodged his right fist and grabbed the male, pushing him into the black car, informing Dalton PD units that [I] was in a 10-10 (fight).” After a brief struggle, the officer was able to place his arms behind his back and arrest him. Officer Mefford arrived on the scene and assisted with walking Fernando to a patrol vehicle. The female who was involved in the argument with the male informed officers that they were just talking and nothing bad happened. This is all the female would tell officers. She wouldn’t say anything else about what happened. A witness stated Fernando arrived at the address on James Street drunk and would not leave. The victim got into Fernando’s vehicle to talk with him when he began to accelerate to leave with her inside. The witness stated that he moved his silver pickup truck in the middle of the road to block passage. The witness stated Fernando then hit his silver pickup truck attempting to leave. Fernando then got out of his vehicle, wanting to fight the man. Officer Avila reported, “[I] asked (the victim) “Is this true?” (the victim) would not confirm anything violent or aggressive happened. Officer Mefford found open containers inside the car. Fernando did not consent to implied consent and asked if Officer Avila could read it to him in Spanish. Officer Avila reported, “[I] asked Fernando, “How many beers did you have?” Fernando stated, “4”. Fernando stated that he did drive and stated that he was already at the residence.” Fernando was transported to the Whitfield County Jail charged with felony obstruction of the law enforcement officer, DUI less safe, driving unlicensed, open container. Booking staff informed the officer that Fernando blew a.182 on the alco-sensor. Later that morning, Officer Avila was contacted by dispatch in reference to the Honda civic. Dispatch advised that they received a delayed hit notification for the vehicle and that it had been stolen from Marietta, GA. According to reports, on Sunday, March 14, 2021 Fernando was found asleep and DUI after crashing on I-75 in Gordon County.
