LaFayette man arrested for DUI after failing to maintain lane on Highway 27 in Chattooga County

According to a Chattooga County Sheriff’s Office incident report, on May 22nd, 2021, at around 8:06 PM, Deputy Wilks was assisting Deputy Armstrong on a traffic stop at Highway 27 and West Halls Valley Road. Deputy Armstrong stated that he observed the vehicle fail to maintain a single lane of travel. One vehicle was stopped. Deputy Armstrong made contact with the driver, identified as Micheal Eugene Penson, 57, of LaFayette, and smelled a strong odor of alcoholic beverage coming from Penson’s breathe. According to the report, “Deputy Wilks conducted field sobriety on the Penson who showed several clues of impairment. Penson also showed positive for an alcoholic beverage on an Alco-Sensor. One can of Natural Light beer was opened sitting in the cup holder in the front of the vehicle, and more unopened container found just behind the driver’s seat in the vehicle.” Penson refused Georgia’s implied consent notice. Penson was transported to the Chattooga County Jail, charged with failure to maintain lane, open container of alcohol, and DUI less safe (refusal).
