According to a Floyd County Police Department incident report, on November 26th, 2021, at around 7:39 AM, Officer Matthew and Officer Moore responded to a physical domestic at the residence at the address of Grove Avenue. Officer Moore reported, “[I] arrived on scene first and witnessed a large black male carrying a tv and sweating profusely while screaming profanities. [I] also witnessed a smaller framed white woman later identified as Robin Delanae Rodriguez, 35, of Lindale, grabbing at him as he threw the tv on the ground. The black male later identified as Darius Rashad Gibbons, 32 of Lindale, then turned to me and yelled, “take me to jail, [I] deserve it” and other things that were unable to be understood as he was in a moment of distress. [I] quickly detained the black male to eliminate some of the chaos that was unfolding in the front yard of this property, then detained the female.” According to the report, Rodriguez had a red spot on her neck in the center of her throat about the size of his thumb. Gibbons stated that later while detained that he did grab her by the neck in an effort to get her off of him. Rodriguez alleged that she didn’t do anything and that she was the victim, but while assessing the damages in the residence, the officer noticed a shell casing that later matched the weapon found in the vehicle. Officer Moore reported, “Due to the amount of pre-existing holes in the sheetrock, we were unable to determine if the weapon had been fired. Gibbons stated that Rodriguez shot at him once he advised he was leaving and done with the relationship.” The firearm found in the silver Dodge Ram was claimed by Gibbons, who was a convicted felon. Rodriguez also stated that Gibbons slammed her head into the washing machine. Both Gibbons and Rodriguez were transported to the Floyd County Jail. Gibbons was charged with battery and possession of a firearm by a convicted felon. Rodriguez was charged with battery.
