When David responded, [I] noticed that his speech was very slurred. [I] then asked David for his license, and he complied and gave me his license. However, he was slow and seemed to have to concentrate very much on this simple task. [I] then asked David to step out of his vehicle and to the rear of the vehicle. When David did so, [I] observed that he was very uneasy on his feet. [I] then advised David that [I] could smell alcohol on his breath. [I] then asked David how much he had been drinking. David answered that he had only consumed “two drinks”. He stated that he drank “Rum and coke”. When he responded to me, [I] could still detect his speech to be slow and slurred.” During field sobriety tests, David showed several signs of impairment. David then stated that he had maybe “Three drinks with my cousin”. David was placed under arrest for DUI and transported to the Whitfield County Jail, where he showed a BAC of .177 on the state test.
