Resaca motorcyclist arrested for DUI after being stopped for weaving over the roadway in Dalton

According to a Dalton Police Department incident report, On May 13th, 2022, at 11:00 PM, Officer Selby stopped a motorcycle on West Walnut Avenue near Miller Street after observing the motorcyclist fail to maintain a lane. Officer Selby reported, “[I] then approached the motorcycle. When [I] made contact with the driver, Christian La Hentz Ivey, 26, of Resaca, [I] could detect a strong odor of an alcoholic beverage coming from him. This was surprising as he was currently wearing a helmet that covered his mouth and the majority of his face. Ivey then openly admitted to being that he had only drank one beer prior to driving. Ivey stated this prior to me asking or stating anything about the consumption of alcohol.” When Ivey took off his helmet and began to speak, the officer again detected a strong odor of an alcoholic beverage coming from his mouth area. The officer also observed that his eyes were glassy. During field sobriety tests, Everyone showed several signs of impairment and was placed under arrest for DUI. Ivey read Ivey the implied consent notice for suspects age 21 or over. Officer Selby reported, “While reading this card to him, he told me he did not want to do a chemical test. [I] then finished reading the implied consent notice to Ivey and asked for a breath. Ivey said, “Yes, of course”. He then stated that he would like a breath test. While transporting Ivey to the Whitfield County Jail, he began to question me and ask if [I] arrested him because he slurred too much. He asked me this question to me while slurring his speech. Once at the jail, Ivey stated that he did not want to give breath. Ivey was charged with DUI (alcohol less safe), weaving over the roadway, and driving on an expired license (motorcycle permit expired).
