Rocky Face man arrested after letting child drive truck while DUI in Whitfield County

According to a Whitfield County Sheriff’s Office incident report, on May 1st, 2021, at approximately 8:32 PM, Deputy Tabellion was sitting stationary at Old Lafayette Road and Sam Love Road when he was flagged down by a concerned motorist that stated a Red Dodge pickup in front of them was all over the road. The deputy turned onto Mill Creek Road. He observed the Red Dodge pickup turn onto Clay Hill Drive, then immediately place the truck in reverse and backed onto Mill Creek Road, causing another vehicle to slam on their brakes to avoid a collision. The deputy activated his emergency blue lights and initiated a traffic stop. The deputy made contact with the driver and advised the reason for the stop. The driver was identified as Andrew Douglas Allen Griffith, 32, of Rocky Face. Griffith immediately stated to the deputy that the passenger, who was identified as a 9-year-old Juvenile, was driving the vehicle. The deputy had Griffith step out of the vehicle, so the juvenile did not have to hear the encounter. The deputy reported he smelled the distinct odor of an alcoholic beverage emitting from the mouth area of Griffith. The deputy also reported that Griffith’s eyes were glassy and red. Griffith refused to perform Standardized Field Sobriety testing, stating that he would not perform the test because he knew he would fail them. Griffith stated that he had a couple of beers. Griffith refused to comply with the implied consent testing. Griffith stated that he went to Ringgold to pick up a couch and stopped at the Racetrac on Shugart Road on his way back home. Griffith stated that the juvenile was sitting on his lap, operating the vehicle up until the time he was pulled over. Griffith stated that they pulled onto Clay Hill Drive because the juvenile saw the lights, and it made him nervous. Griffith stated that he has been letting juvenile drive to help teach him to drive. Griffith’s Girlfriend arrived on the scene to take the juvenile home. The Dodge Truck was also towed due to it not having insurance. During an inventory search of the vehicle, several cans of alcohol opened and unopened were located. These cans of alcohol were still cold, and there was a receipt in the vehicle timestamped for May 1st, 2021, at 8:01 PM. Griffith was transported to the Whitfield County Jail charged with DUI -less safe, DUI-child endangerment, driving while license is suspended.
