According to a Floyd County Police Department incident report, On January 18th, 2022, at around 5:41 PM, Officer Dollar responded to 1203 Cave Spring Road in reference to a possible DUI. According to the report, “While en-route, dispatch advised that the complainant (Witness), was following the vehicle from Walker Mountain Store. He informed dispatch that the driver had a baby in the vehicle with her. Dispatch was able to run the vehicle registration based on the tag number the caller gave them. The registration returned to a black 2014 Nissan Maxima, and the owner had current warrants. Dispatch was later able to determine that the vehicle owner was already incarcerated. The caller advised dispatch that the vehicle pulled into the parking lot of 1203 Cave Spring Road.” Officer George and Sgt. Glaze arrived on the scene before Officer Dollar and was able to make contact with the vehicle and the driver identified as Marilyn White, 35, of Rome. Officer Dollar reported, “[I] made contact with Marilyn. It should be noted that [I] detected a strong odor of an alcoholic beverage dissipating from Marilyn’s breath even with Marilyn wearing a surgical face mask over her nose and mouth. [I] asked Marilyn if she had recently consumed an alcoholic drink. Marilyn stated she had a small amount of a four loko earlier. During field sobriety tests, Marilyn showed several clues of impairment and showed a BAC of .123 on PBT. Marilyn was then placed under arrest for DUI. Marilyn agrees to conduct the state breath test. Officer Dollar reported, “[I] made contact with the vehicle Marilyn was driving. [I] did observe an infant (Victim), in the front passenger seat. He was in a rear-facing car seat secured to the passenger seat but was not buckled into the car seat. Officer Masciovecchio located an open gas station fountain drink cup containing an alcoholic beverage. There were other alcoholic beverages also located.” According to the witness, Marilyn pulled up to the Walker Mountain Store parking lot. She then drank a random alcoholic beverage sitting on top of the ice cooler then proceeded to take the infant into the store with her while she played slot machines. According to the report, The concerned citizen advised officers that while Marilyn was putting the baby back into the car, she was stumbling around so bad that she caused the baby to strike the door frame of the vehicle with its head. The concerned citizen advised officers he then followed Marilyn and called 911 while she drove all over the roadway. On the state breath test, Marilyn showed a BAC of .122. Marilyn was then booked into the Floyd County Jail, charged with DUI, open container violation, endangering a child by DUI, seat belt requirement for children violation, and driving without insurance.
