According to a Floyd County Police Department incident report, on April 22nd, 2021, at 1:11 AM, Officer Carlos Ribot-Aviles was on Ga 101 (Rockmart Highway) across from Southern Pride Gas Station. Officer Carlos Ribot-Aviles attempted to stop a dark color Dodge Dakota that passed his location. The officer estimated that the vehicle was going over 80MPH in the 55MPH zone. The officer reported he had reason to believe the driver was operating the vehicle in a reckless manner by “disregarding the safety of the public and property and speeding well over the speed limit”. Officer Carlos Ribot-Aviles reported, “[I] had to go over 100MPH to catch up to the pickup and get him to stop”. The vehicle stopped at Midway School Road, where the officer made contact with the driver, Shawn Collin McDougal, 21, of Silver Creek who admitted operating his vehicle at 80 MPH. The officer was able to smell the odor of alcoholic beverages coming from McDougal, who admitted to alcohol consumption. McDougal’s speech was a slur and was also very repetitive. His eyes were dilated, and he said that he took some medication that will affect him with alcohol use. While outside the vehicle, he was leaning over the vehicle to keep his balance and continue to repeat some comments. Officer Forrister arrived on the scene and assisted with the traffic stop. McDougal showed several clues of impairment during field soberly testing. The officer also asked him about an incident that happened in the city, where a vehicle matching his fled police. McDougal said that he never saw any blue lights or heard a siren around the city area. McDougal agreed to the state implied consent test. He also requested to call his mother, which the officer did. McDougal informed his mother that he was arrested because of his medication, and he took a shot. At 2:16 AM, McDougal showed a BAC of 0.186.
