According to a Catoosa County Sheriff’s Office incident report, On Friday September 30th, 2022, at 9:54 PM, Deputy Kuzma was sitting on Steele Road running stationary radar when he observed a 2004 Dodge Ram speeding 46 mph in a 30 mph. Deputy Kuzma initiated a traffic stop and made contact with Bradley D Durham, 34, of Tennessee. According to the report, “While Deputy Kuzma was asking for Durham’s information he could smell a strong odor of an alcoholic beverage coming from his breath. Deputy Kuzma also saw that Durham’s eyes were watery. Deputy Kuzma got Durham’s information and asked him if he had anything to drink tonight and which he stated yes. Durham told Deputy Kuzma that he only had a beer.” Deputy Kuzma asked Durham if he would be willing to do some field sobriety tests to much sure he was ok to drive and he stated no. Durham told Lt Cunningham the same thing he told Deputy Kuzma and asked if he could have his friend who was on the motorcycle or his ex wife which he stated just lived down the road and where he was heading to could come drive him home. Deputies told Durham that was not going to be a option and that based on everything Deputy Kuzma observed he would be placed under arrest for DUI. When Durham opened the driver door Deputy Kuzma saw a open container in the cup holder. According to the report, “Deputy Kuzma picked up the beer can and felt that it was cold to the touch, the Michelob Ultra beer can sitting in the cup holder inside the drivers side door with approximately less than a quarter of beer left inside of it. Once inside the patrol car Deputy Kuzma told Durham that he had to read him something and after he was done reading it he just needed a yes or no. Durham told Deputy Kuzma that the was going to make his life hard and miserable for him and that he would just talk over Deputy Kuzma when he started to read Implied Consent.” Deputy Kuzma started to read Implied Consent to Durham and he started throwing a tantrum talking loud and over Deputy Kuzma. Durham was booked into the Catoosa County Jail, charged with speeding, open container violation, DUI less safe.
