According to a Chattooga County Sheriff’s Office incident report, on New Years Day, January 1st, 2022, at or around 2:12 AM, Deputy Jared Wilks, was traveling southbound on Highway 27 in the area of El Publito when he observed a black truck swerving and failing to maintain a single lane of travel by crossing the white center line and veering into the center turning lane. Deputy Wilks reported, “[I] turned on my emergency light as we turned left onto Farrar Dr when the vehicle exited the road almost striking a no littering sign then correcting the vehicle coming back onto the roadway. The vehicle continued to the back parking lot of the Oakview Nursing home before coming to a complete stop. [I] approached the driver’s side of the vehicle, and the subject rolled down the window and started to whine, saying, “please, please, officer.” The subject kept saying please over and over. [I], Deputy Wilks, smelled a strong odor of alcoholic beverage coming from the subject’s breathe. The driver finally gave me his driver’s license after asking for it multiple times.” The deputy identified the driver as Dillion Andrew Smith, 26, of Trion, and told him the reason for the stop. According to the report, “Mr. Smith stated that he was sorry he was just coming to pick up a girl but did not say where he was going.” Deputy Wilks reported, “During Horizontal Gaze Nystagmus (HGN) Smith showed 6 of 6 clues, lack of smooth pursuit in both eyes, Nystagmus at maximum deviation in both eyes, Nystagmus at onset prior to 45 degrees, and Nystagmus at vertical gaze indicating a high dose of alcoholic beverage for that person. Smith showed several clues during the remaining field sobriety tests and showed positive for alcoholic beverages (.217) on a PBT. Deputy Wilks reported, “During field sobriety, Smith stated that we needed to take him to jail because we were on the property of his work.” Smith was read Georgia Implied Consent, and he refused the state test. Smith was transported to the Chattooga County Jail charged with DUI-Alcohol (refusal) and failure to maintain lane.
