According to a Whitfield County Sheriff’s Office incident report, on May 8th, 2021, Deputy Crosby was requested by Deputy Thompson to assist in a driving under the influence investigation. According to the report, “Deputy Crosby arrived at the scene and was advised that the reason for the stop was the listed vehicle did not have operating tail lights. Deputy Thompson stated he could smell the strong odor of an alcoholic beverage coming from inside the vehicle. Deputy Thompson provided Mr. Morales’ Guatemalan identification stating Mr. Morales did not have a driver’s license. Once away from the vehicle, Deputy Crosby could smell the odor of an alcoholic beverage coming from Mr. Morales’ breath and person. Mr. Morales’ eyes were bloodshot and watery. His speech was slurred, and he appeared to not be able to keep his balance.” The deputy asked if Morales had drunk any alcoholic beverages, to which he replied, “five.” According to the report, “Deputy Crosby clarified and asked, “five beers?” Mr. Morales said “yes.” Deputy Crosby then asked Mr. Morales if he would submit to the standardized field sobriety tests, which he agreed” Morales showed several clues of impairment during testing and refused the one leg test stating “you can take me to jail.” Morales was placed under arrest for DUI. Morales stated he did not understand implied consent and refused the test. Morales was transported to Whitfield County Jail charged with DUI less safe, driving while unlicensed, and taillight requirement.
