According to a Dalton Police Department incident report, On July 29th, 2022, 11:42 PM, Officer Sosa was conducting a traffic stop located at West Walnut Ave and Rucky Drive when he observed a Toyota Tacoma drive past without any headlights on. The driver, later identified as Jorge Luis Fraire-Fraire, 26, of Dalton, stopped across the street on Rucky Drive and began staggering down east on West Walnut Avenue. Officer Sosa reported, “[I] notice Jorge having a hard time walking on the sidewalk. Jorge was stumbling over his steps and almost fell over while walking; [I] then completed the traffic stop and noticed again the driver of the Toyota Tacoma walking back to the vehicle and still having a hard time walking.” Lt. Alan Woods then stopped the Toyota Tacoma, which was heading west on West Walnut Ave with no headlights,. Officers immediately noticed a strong odor of alcoholic beverages coming from the vehicle. Officers then learned Jorge did not have a valid license. According to the report, Jorge then stated that the last time he was drinking was last night, and today, he was only hung over from the night before. Jorge was asked if he could do a field sobriety test, and he stated that it was ok, but he knew he was going to fail the test because he felt that he still had alcohol from the night before in his system.” Jorge showed several signs of impairment and showed a BAC of .157 on a PBT. Jorge was laced under arrest for DUI and advised he was not a US citizen. Jorge was booked into the Whitfield County Jail, where he showed a BrAC of .158. Jorge was charged with DUI, driving with no valid license and driving with no headlights.
