Unlicensed man arrested for DUI after running stop sign and failing to maintain lane in Dalton

According to a Dalton Police Department incident report, On October 9th, 2022, at 12:54 AM, Officer Bethune was watching traffic in the area of Willowdale Road and Kimberly Park Drive. Officer Bethune reported, “[I] was specifically watching for vehicles that do not stop at the stop sign at this intersection due to recent complaints.” While watching traffic, a 2007 Ford Focus was observed failing to stop at the stop sign. Officer Bethune reported, “While following the vehicle, [I] observed it fail to maintain its lane of travel and cross over the double yellow line.” Officer Bethune initiated a traffic stop and made contact with the driver, later identified as Vicente Herrera Hernandez, 39, of Calhoun. Officer Bethune immediately noticed that his eyes were bloodshot (red) and glassy. Officer Bethune also detected a strong odor of an alcoholic beverage coming from his breath and noticed an open container of Michelob ultra beer in the cup holder. Officer Bethune reported, “[I] then had Vicente exit the vehicle and walk to the rear of the vehicle. When he exited the vehicle, [I] noticed that he was uneasy on his feet. Once at the rear of the vehicle, [I] asked Vicente how much he had had to drink, at which point he stated that he had only three corona beers at a bar and was going home to his residence in Calhoun. While speaking with Vicente, [I] again detected a strong odor of an alcoholic beverage coming from his person/mouth area.” Officer Herrera was requested to the due to an extreme language barrier. During field sobriety tests, Vicente showed several signs of impairment and was placed under arrest for DUI. Vicente was transported to the Whitfield County Jail, where he showed a BrAC of .217 on the state test. Vicente was charged with DUI with alcohol 0.08 g or more, open container, driving while unlicensed, failure to stop at a stop sign, and failure to maintain lane. He was not eligible for a temporary driving permit due to his not having a valid license.
