Unlicensed man arrested for DUI again after avoiding DUI checkpoint and switching seats in Rome

According to a Georgia State Patrol incident report, On September 24th, 2022, at 1:33 AM, Trooper Clark of LaFayette Post 41 was participating in an approved DUI road check at West 3rd Street and North 2nd Avenue in the city of Rome, GA, when a black 2017 Honda Accord attempted to avoid the checkpoint. Trooper Clark reported, “The black Honda Accord pulled behind a business, and the male driver swapped seats with the female passenger. At this time, SFC Buckner performed a traffic stop on the black Honda Accord and observed the driver and passenger switch seats. TFC Whitfield and [I] conducted the investigation. TFC Whitfield spoke with the female subject as [I] spoke with the male subject.” Trooper Clark asked the male later identified as Luis Esteban Pizano, 22, of Rome, for his driver’s license, and he handed the trooper a Georgia Identification card. Trooper Clark observed his eyes to be bloodshot and watery while speaking with him. He also could smell a strong odor of alcoholic beverage coming from Pizano’s breath. Trooper Clark reported, “[I] asked Mr. Pizano how much alcohol he had drank tonight, and he stated he had just left Giggity’s Sports Bar and had a pitcher of beer and a shot. Mr. Pizano also stated that the reason they pulled over and swapped seats was that he was suspended.” During field sobriety tests, Pizano showed several signs of impairment. Trooper Clark reported, “[I] then explained the instructions to the One Leg Stand (OLS) test, which Mr. Pizano stated, “I’ll be real with you boss, I ain’t got time to be testing all that bruh. Just arrest me for DUI”. Pizano showed a BAC of .193 on a PBT. Pizano was then placed under arrest for DUI and refused the state test. Pizano was also found in possession of marijuana and to have several warrants failing to appear original charge of DUI. Pizano was run through GCIC and returned suspended for implied consent (DUI refusal) with a violation date: of 05/19/2022 and a suspension date: of 07/04/2022. Pizano was transported to the Floyd County Jail and charged with DUI refusal, driving while suspended, possession of drug-related objects, possession of marijuana, and failure to appear x4.
