Woman arrested after permitting husband to drive her truck while DUI in Rossville

According to a Rossville Police Department incident report, On October 15th, 2022, at 12:49 AM, Officer Thomason was sitting stationary at the Rossville Post Office when he observed a 2005 Dodge Ram 1500 turn onto Chickamauga Avenue from West Gordon Avenue at the red light when it is posted to no turn right on red. Officer Thomason observed the vehicle fail to maintain the lane and conducted a traffic stop. Officer Thomason made contact with the driver, identified as Michael Lee Smith, 37, of Rossville, and immediately detected the strong odor of an alcoholic beverage coming from his breath. Officer Thomason reported, “Mr. Smith had watery eyes, and when [I] asked for his license, he struggled to pull a license out of his wallet, and he provided me with his wife’s, Brooke Smith, 40, of Rossville, license. [I] pointed out that he gave me the wrong license, and he apologized and struggled to get his own license out of his wallet. Mr. Smith slurred his words as he spoke and [I] asked him to step out of the vehicle, and he agreed.” Mr. Smith stumbled and swayed as he walked to the back of the vehicle. During field sobriety tests, Mr. Smith showed several signs of impairment and a BAC of .166 on a PBT. Mr. Smith advised the officer he tried to get an Uber but his wife wanted him to drive home since it was her truck. The officer spoke to Mrs. Smith and noticed an open bud light bottle in the passenger door. According to the report, Mrs. Smith stated it was hers. She also agreed that it was her car, and she wanted her husband to drive home. Mrs. Smith was also placed under arrested for permitting her husband to drive while drunk. Both were transported to the Walker County Jail and booked. Micheal was charged with DUI, failure to obey traffic control device, and failure to maintain lane. Brooke was charged open container violation and permitting unlawful operation of a vehicle.
